This is a significant Class Action Lawsuit against the U.S. Department of Education, its loan servicers, and the three major credit bureaus—Equifax, TransUnion, and Experian. The core issue is the alleged unfair and inaccurate categorization and reporting of millions of student loan borrowers as being seriously delinquent or in default on their loans and the significant negative impact this unfair categorization is having on credit bureau scores.
This widespread misclassification, impacting 5 million individuals and potentially up to 20 million individuals, is attributed to serious operational service failures by the U.S. Department of Education and its contractors. Individuals declared to be seriously delinquent or in default on their student loans since January 1, 2025, are eligible to join this lawsuit, which aims to address the harm caused by these erroneous unfair and inaccurate reports furnished to the credit bureaus.
