Attorney Devlin Cooper and Dr. Wayne Johnson are launching a Class Action Lawsuit against the U.S. Department of Education, Equifax, Experian, and TransUnion asserting that the U.S. Department of Education has improperly placed millions of federal student loan borrowers into default or in a reported state of serious delinquency. Dr. Johnson, a former COO of the Office of Federal Student Aid, highlights that the U.S. Department of Education has failed operationally to handle the restart of loan payments, leading to borrowers being unable to communicate with servicers and thus unfairly accumulating delinquencies that roll into default.
This results in inaccurate and unfair credit reporting, which then negatively impacts credit scores and leads to higher interest rates from other lenders, causing significant financial harm. The lawsuit aims to remove this false information from credit reports, suspend credit reporting until the U.S. Department of Education is capable of meeting its obligations, and seek at least $100,000 in damages for each affected individual, emphasizing accountability for the federal government and credit bureaus.
